Since Sierra is no longer ESA, will the Gabriel Knight games ever be available for download here?

Since Gabriel Knight 2 is 6 CDs, I think you'd have better luck getting it on ebay ;). GK3 is pretty large as well. They're really worth just buying.

If Sierra is enforcing it's Copyright then no. otherwise... maybe who knows...

There is a chance for the first one, yes.
Both sequels are simply way too large to host them on site, but they might make it into ISO Cellar.

Remember though: the removal of ESA protection doesn't automatically make all of Sierra games abandonware. They still must fulfill the "no new copies sold individually OR in compilations" and "not supported by the publisher/developer".

Unless Kosta gives a different verdict on using Amazon for status verification, we have to wait till all those are gone.
I've tried to contact him to get clarification on this matter, but the mail bounced due to his account being completely filled up. So for the moment we have to assume Amazon Marketplace as a valid source, even if it might be not (which annoys me to no end).

Since when do second hand copies count? They're not sold by Amazon itself. It's just Amazon's own eBay.
