I would say that the Abandonware part of the ESA is useless and a waste of money...

This is a perfect example of someone who don't know better and who just don't like ESA because it happen to be in his way...

Yes. There is no abandonware section of ESA they just protect ALL games by the company that pays them.

They protect the copyrights of gaming companies, yes, but only thos who pay them, so I don't really see the charity part...
And of course it is useless for them to protect the copyright of something that isn't made anymore, and thus actually toughen the preserving of the old games, by the people who really want to preserve it...

I don't know what's with such a pro ESA attitude here, I can understand companies protecting their copyrights where it is actually usefull, but you people act like ESA is somekind of deity or something, ridicoulus...

ah but how do we know it will never be made anymore? let's say you wanted to make a sequel to commander keen, and ebcause your copyrights wasn't protected someone else made it and sold it with a huge profit. now he has all the fame and money and all because he used the Keen's story as background to his game.

That's not copyright, that's trademark, so the Commander Keen is the trademark of XY company, those are two different things...

Copy right is just that, the right to freely copy the product, not the right for it's name etc.

Why are we even having this discusion?

People don't hate ESA because they don't know who they are or what they do, but because they prevent them from getting excelent games (preferably for free). I personally strongly dislike them, because we are not allowed to host many great games because of them, but I still respect them and am doing my best to keep Abandonia safe from another ESA encounter (the one we had was quite enough).

But then again, I also understan the cop who's just doing his job while handing me the traffic ticket, still I'll hate him for it (although he's right and I'm wrong).
